During the term of the Contract the Insurance Consultant will be expected to provide Services which will consist (but will not be limited to) of the services indicated below:1.1. Act as Contracting Authority’s Insurance Consultant and risk management advisor, as applicable.1.2. Provide Services consistent with the terms and conditions outlined in the Contract.1.3. Assess the new nuclear power plant (NNPP) Project’s risk exposures, insurance needs and provide recommendations regarding the appropriate types of insurance for the NNPP Project, the levels of coverage necessary to protect the Contracting Authority from reasonable risks, the levels of deductible for each policy to provide the best balance of risk limitation and lower premium and such other factors as the Insurance Consultant shall recommend.1.4. Respond to Contracting Authority’s questions related to insurance policies and coverage.1.5. Represent the Contracting Authority, as directed, in any negotiations with contracting parties in the NNPP Project and other parties regarding insurance matters.1.6. Evaluate offers on the insurance policies and coverage and present to the Contracting Authority the package of insurance policy terms, conditions and premiums that best reflects the goals and objectives of the Contracting Authority.1.7. Review of all necessary specifications, coverage and premium analysis related to selection of insurers.1.8. Provide review of contracts related to the implementation of the NNPP Project regarding compliance with negotiated insurance policies and coverage and provide offers on improvements thereto.1.9. Notify the Contracting Authority of any new developments in the industry or markets generally that affect the NNPP Project in any way or that impact the insurance coverage or policies sought by the Contracting Authority.1.10. According to demand, provide any consultations and support to the Contracting Authority required during the pre-EPC phase and related to the insurance policies and coverage. Limited scope of such services is envisaged.1.11. Also, to provide advice on matters such as:1.11.1. Non-Nuclear Risk Insurance:Insurance of Transportation by Road and (or) Sea;Insurance of Non-Nuclear Property;Insurance of Machinery Break Down;Insurance of Business Interruption (Errors and Omissions);Insurance of Construction / erection risks.1.11.2. Nuclear Risk Insurance:Insurance of Civil Liability for Nuclear Damage (Vienna Convention regime);Insurance of Worker Radiation Claim;Insurance of Nuclear Property;Insurance of Transportation (by Road/Sea) of Nuclear Materials and Fuel.1.11.3. Other:Allocation of risks and indicating parties by whom the covers will be taken;Maximum insurance capacity;Insurance Maintenance Period;Consultancies on Vienna Convention;The levels of the deductibles / excess.200 000,00

The tender is a simplified negotiated procedure with prior publication of notice. This mode of procurement is regulated under Chapter IV of the Law on Public Procurement of the Republic of Lithuania and Simplified Public Procurement Rules of the Contracting Authority available at http://mw.eviesiejipirkimai.lt/vpm/K22N_FILES/SVPTS/1000021457.pdf (in Lithuanian). The tender is conducted vie electronic means. Tenders may be submitted only via electronic means of Central Public Procurement Information System ("CPP IS"; available under address: https://pirkimai.eviesiejipirkimai.lt). In order to submit the tender, bidders shall register at the CPP IS. Registration at the CPP IS is free of charge. The tenders shall be signed with a secure ditigalt signature in accordance with the Law on Electronic Signature of the Republic of Lithuania.

Parinkčių aprašymas:

The parties of the contract may agree to extend the term of the Consultant’s appointment for the period from the conclusion of the Concession Agreement in the new nuclear power plant project in Lithuania until the project implementation company selects the consultant to perform other insurance consultancy tasks but not longer than 1 year after the conclusion of the Concession Agreement.

The CEO of the Bidder, as a legal entity, or other person having to right to make a transaction on behalf of the Bidder, an accountant or other person having the right to draw up and sign the Bidder’s accounting documents, has no valid or non-cancelled conviction, and no conviction has been made or came into effect in respect of the Bidder, as a legal entity, during the recent 5 years for participation in a criminal association, organisation or direction thereof, for bribery, mediating bribery, offering bribes, fraud, use of credit, loan or target support not in accordance with the intended purpose or under the established procedure, credit fraud, tax evasion, submission of false data about income, profit or property, failure to submit a declaration, account or other document, acquisition and realisation of property gained in a criminal way, legalisation of money or property acquired in a criminal way, or in case of foreign Bidders no conviction is made or came into effect for the offences defined in the European Union legal acts enumerated in Part 1 of Article 45 of the Directive 2004/18/EC of the European Parliament and of the Council of 31.3.2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts.

Documents showing the compliance with the above requirements:

For Lithuanian Bidder: A certificate issued by the Informatics and Communications Department under the Ministry of the Interior of the Republic of Lithuania or a certificate of the state enterprise Centre of Registers, confirming that the Bidder has no unexpired conviction for the criminal acts stipulated in this item.

For foreign Bidders: Documents issued by the authorised foreign institution confirming that (i) the Bidder, (ii) the Bidder’s CEO and other persons acting in the name of the Bidder, (iii) an accountant or other person having the right to draw up and sign the Bidder’s accounting documents, has no unexpired conviction for the criminal acts stipulated in this item.

If in the country of the Bidder’s domicile such documents are not issued or do not cover all relevant issues, such documents may be replaced by Bidder’s declaration of oath.

The documents shall be issued not earlier than 60 days prior to the term of submission of the Proposals. If the document is issued earlier but its validity term is longer than the term for submission of the Proposals, such document shall be acceptable.

1. The Bidder during the last 3 years or, if he has been registered later, since its date of registration, timely and appropriate provided insurance consulting services for nuclear power plant development (construction) projects.

Documents showing the compliance:

1) Documents relating to the insurance consulting services to the nuclear power plants development (construction) projects over the past 3 years or, if the Bidder is registered later, during the period of registration of the Bidder, along with details of scope of services provided, name of the client, dates of services provision and completion of the plant; and

2) Statement from the client in the referred project indicating services which were provided and stating that the services were provided in a timely and properly way.

2. The Bidder has appointed the Project Manager with experience in at least one nuclear power plant development (construction) project over the past 5 years.

CV signed by the Project Manager showing his / her involvement as the project manager for provision of Insurance Consultancy services, name of the client (if not confidential), dates and description of services provided.

The Consultant shall be paid the blended hourly rate as remuneration for the satisfactory performance of the Services. The Employer shall approve or reject (in whole or in part) invoices submitted by the Consultant within 10 days of their submission. All invoices shall be due and payment shall be received by the Consultant (as to all undisputed amounts) within a period of 30 days following the date on which the invoice and report of services was submitted.
